Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(二)专人送达、回收意见:由业主委员会(或筹备组)会同村(居)委会等有关人员逐户送发和回收业主意见,经业主委员会统计汇总,公布表决结果。以快递方式收回的选票必须由业主本人签名,在开票当天统一拆封。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(三)业主共同决定事项电子投票方式表决:业主、业主大会采用市住房城乡建设行政主管部门建立的业主共同决定事项电子投票系统进行投票表决,具体规则详见《东莞市业主共同决定事项电子投票规则(试行)》。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(四)</span></span><span style="text-decoration:underline;"><span style="font-family: 'Times New Roman';font-size: 21px"> </span></span><span style="text-decoration:underline;"><span style="font-family: 仿宋_GB2312;font-size: 21px"><span style="font-family:Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主表决可以优先采用电子投票方式。采用电子投票方式的,应当使用市物业信息系统中的电子投票系统。</span></span></p><p style="text-indent:41px"><strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">第九条</span> </span></strong><span style=";font-family:'Times New Roman';font-size:21px"> <span style="font-family:仿宋_GB2312">业主大会组织者应当于业主大会会议召开前</span>15<span style="font-family:仿宋_GB2312">日,将会议时间,地点、议题和议程在物业管理区域的显著位置公告,并书面或电子文档通知全体业主。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">公示内容应当至少包括以下内容:</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(一)业主大会会议召开的时间、地点、形式和内容;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(二)业主大会组织者拟定的管理规约草案和业主大会议事规则草案,并需要对修改市住房和城乡建设局提供范本的部分予以书面说明;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(三)业主身份以及投票权数;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(四)业主委员会委员候选人产生办法及名单;具体包括但不限于业主委员会委员候选人的姓名、性别、政治面貌、入住时间、物业费和住宅专项维修资金缴纳、有无犯罪记录、履行业主法定义务、物业管理相关违法违规、书面承诺情况;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(五)选票发放人、计票人和监票人产生方式及名单;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(六)其他根据法律法规政策规定需要公示的内容。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">公告的内容除了前述事项外,还需要将村(居)民委员会的有关意见进行公告;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主可以委托他人参加业主大会会议。业主委托他人参加业主大会会议的,应当出具书面委托书,载明委托事项、委托权限及期限。</span></span></p><p style="text-indent:41px"><strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">第十条</span> </span></strong><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主大会会议分为定期会议和临时会议,定期会议应当按照业主大会议事规则的规定召开。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">有下列情形之一的,业主委员会或者物业管理委员会应当在三十日内组织召开业主大会临时会议:</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(一)占业主总人数百分之二十以上业主或者占小区总票权面积百分之二十以上业主提议的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(二)业主委员会或者物业管理委员会决定召开的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(三)业主委员会委员、候补委员发生本条例第四十条所列禁止行为的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(四)业主大会议事规则规定的其他情形。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">发生其他重大事故或者紧急事件需要及时召开业主大会临时会议处理的,业主委员会或者物业管理委员会应当及时组织召开。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">发生本条第二、三款规定的情形,业主委员会或者物业管理委员会未及时组织召开业主大会临时会议的,业主可以向物业所在地镇人民政府(街道办事处)提出协助要求,镇人民政府(街道办事处)应当责令业业主委员会或者物业管理委员会限期组织召开,并通告全体业主。</span></span></p><p style="text-indent:41px"><strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">第十一条</span></span></strong><span style=";font-family:'Times New Roman';font-size:21px"> <span style="font-family:仿宋_GB2312">业主大会会议按下列程序召开:</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(一)会议筹备。业主大会组织者做好开会前的准备工作。根据业主的提议,草拟会议议题,确定会议召开形式、时间、地点、议程,制定征询意见表或选票,核实业主人数、专有部分面积、建筑物总面积等情况。</span></span></p><p style="text-indent:43px;line-height:40px;background:rgb(255,255,255)"><span style="font-family: 仿宋_GB2312;font-size: 21px">存在下列情形之一的,视为业主委员会、业主大会决策的重大事项:</span></p><p style="text-indent:43px;line-height:40px;background:rgb(255,255,255)"><span style="font-family: 仿宋_GB2312;font-size: 21px">第一,重大工程项目,即有关工程施工范围影响物业管理区域三分之一以上的建筑面积或者三分之一以上的业主;</span></p><p style="text-indent:43px;line-height:40px;background:rgb(255,255,255)"><span style="font-family: 仿宋_GB2312;font-size: 21px">第二,涉及大额资金的支出或者收入项目,即项目总金额超过五万元人民币的;</span></p><p style="text-indent:43px;line-height:40px;background:rgb(255,255,255)"><span style="font-family: 仿宋_GB2312;font-size: 21px">第三,征求业主意见开展各类诉讼(含特别程序)或者仲裁或者行政投诉活动的;</span></p><p style="text-indent:43px;line-height:40px;background:rgb(255,255,255)"><span style="font-family: 仿宋_GB2312;font-size: 21px">第四,选聘、更换、解聘物业服务人的;</span></p><p style="text-indent:43px;line-height:40px;background:rgb(255,255,255)"><span style="font-family: 仿宋_GB2312;font-size: 21px">第五,进行业主委员会委员调整的;</span></p><p style="text-indent:43px;line-height:40px;background:rgb(255,255,255)"><span style="font-family: 仿宋_GB2312;font-size: 21px">第六,村(居)民委员会认为属于重大的其他事项。</span></p><p style="text-indent:43px"><span style="font-family: 仿宋_GB2312;font-size: 21px">业主委员会、业主大会决策的重大事项应当首先经过村(居)民委员会的书面确认,后召开业主委员会会议、业主大会会议或者全体业主会议进行表决。业主委员会不得擅自就重大事项擅自组织召开业主大会会议、业主委员会会议、全体业主会议。</span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(二)公示</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主大会会议组织者应当于会议召开前,将会议意向议题的具体内容向全体业主公示并征求业主和村(居)民委员会意见,并根据业主和村(居)民委员会的意见对议题的具体内容进行修改完善。公示内容应当至少包括以下内容:</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px">1<span style="font-family:仿宋_GB2312">、业主大会会议召开的时间、地点、形式和内容;</span></span></p><p style="text-indent:41px"><span Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(三)发布公告。业主大会召开会议前</span>15<span style="font-family:仿宋_GB2312">日,由业主委员会将会议的召开形式、时间、地点、议题和议程以书面形式在物业管理区域显著位置公告,并书面通知全体业主。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">本物业管理区域公告发布地点为:</span></span><span style="text-decoration:underline;"><span style="font-family: 'Times New Roman';font-size: 21px"> </span></span><span style="text-decoration:underline;"><span style="font-family: 仿宋_GB2312;font-size: 21px">海名轩公告栏</span></span><span style="text-decoration:underline;"><span style="font-family: 'Times New Roman';font-size: 21px"> </span></span><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">公告的内容除了前述公示事项外,还需要将村(居)民委员会的有关意见和采纳情况进行公告。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(四)征询意见。采用书面征求意见形式的</span>,<span style="font-family:仿宋_GB2312">业主委员会应发放征询意见表或选票,将业主大会议事内容书面征询物业管理区域内业主意见,并将书面征求意见的结果在物业管理区域内公示三十日以上。 </span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(五)回收统计意见。业主委员会会同村(居)委会回收业主意见,进行意见汇总或者票数统计。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(六)通报大会议事决定。业主委员会以书面形式在公告栏通报征询意见或投票统计结果</span>30<span style="font-family:仿宋_GB2312">天以上,接受业主的查询和监督。业主委员会应当做好业主大会会议书面记录并存档。</span></span></p><p style="text-indent:37px"><strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">第十二条</span> </span></strong><span style=";font-family:'Times New Roman';font-size:21px"> <span style="font-family:仿宋_GB2312">业主委托代理人参加业主大会会议的,应符合下列约定:</span> </span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(一)业主是自然人的,应当书面委托物业管理区域内的业主代表、其他业主、物业使用人或者</span></span><span Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(三)拟定共有部分和共有收益的使用、管理方案,并提交业主大会决定;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(四)拟定印章管理、档案管理、财务管理、停车秩序管理、宠物管理、装饰装修管理等规章制度,并提交业主大会决定;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(五)监督住宅专项维修资金的使用,组织住宅专项维修资金的续筹,对未按照要求移交住宅专项维修资金的建设单位和物业服务人、拒不缴纳住宅专项维修资金的业主进行劝喻和催缴;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(六)及时了解业主、物业使用人的意见和建议,督促业主按照约定支付物业费</span>,<span style="font-family:仿宋_GB2312">监督物业服务人履行物业服务合同;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(七)制作和保管业主大会、业主委员会会议纪要、会计凭证、会计账务、财务报表、审计报告等文件,并建立相关档案;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(八)监督管理规约的实施,对业主违反管理规约的行为予以劝阻、制止;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(九)调解因物业使用、维护和管理产生的纠纷;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(十)配合有关部门、镇人民政府(街道办事处)、村(居)民委员会做好物业服务区域内秩序维护、应急处置、社区治理、公益宣传等相关管理工作,并接受其指导和监督;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(十一)法律、法规和规章规定或者业主大会赋予的其他职责。</span></span></p><p style="text-indent:41px"><strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">第十七条</span> </span></strong><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主委员会委员应当从具备以下条件的业主中选举产生:</span> </span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(一)具有完全民事行为能力;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(二)遵纪守法,热心公益事业,责任心强,具有较强的公信力和组织能力,不存在赌博、吸毒、酗酒、嫖娼等恶习,品德优秀;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(三)遵守管理规约,模范履行业主义务,按时交纳住宅专项维修资金和物业服务费用,无损害公共利益行为;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(四)参选时在本物业服务区域内无被有关部门认定违法建设、违法占用物业共有部分等违反《广东省物业管理条例》《东莞市物业管理条例》的有关情况;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(五)不存在故意、过失犯罪的情形以及未曾被采取纪律监察措施;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(六)报名日期截止前二年内无因物业管理相关违法行为受到行政处罚的情况;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(七)本人及其近亲属未在为本物业管理区域提供物业服务的企业及其下属单位无直接利益关系;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(八)按照有关部门和村(居)民委员会的指导意见完成参选承诺并提供业主委员会选举有关的真实和准确信息,不存在任何虚假记载、误导性陈述或者遗漏;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(九)在本物业服务区域居住至少满一年;</span></span></p><p style="text-indent:41px"><span style="text-decoration:underline;"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(十)具有必要的工作时间,具备所需的工作能力,至少能保证每周投入【</span> </span></span><span style="text-decoration:underline;"><span style="font-family: 21px">签署业主委员会委员报名参选承诺书</span></span><span style="text-decoration:underline;"><span style="font-family: 'Times New Roman';font-size: 21px"> </span></span><span style=";font-family:'Times New style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主委员会委员不能委托代理人参加</span></span><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主委员会</span></span><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">会议。</span></span></p><p style="text-indent:41px"><strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">第二十二条</span> </span></strong><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主委员会委员职务终止,有候补委员的,由候补委员依次递补。业主委员会应当及时将业主委员会委员职务终止和候补委员递补的情况在物业管理区域的显著位置公告。</span></span></p><p style="text-indent:40px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主委员会委员缺员,全体候补委员递补后仍未达到法定最低人数要求或者未超过业主大会议事规则约定的业主委员会总人数二分之一的,业主委员会应当组织召开业主大会会议补选,经过补选仍未达到法定最低人数要求或者未超过业主大会议事规则约定的业主委员会总人数二分之一的,业主委员会自动解散。</span></span></p><p style="text-indent:40px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">递补成功的,业主委员会应对重新选出人员在三十日内,向物业所在地的区、县人民政府房地产行政主管部门和街道办事处、乡镇人民政府备案。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">物业管理区域内未能选举产生业主委员会或者业主委员会不能正常履行职责的,物业所在地村(居)民委员会、物业管理委员会可以在镇人民政府(街道办事处)的指导和监督下,组织业主依法决定有关共有和共同管理权利的重大事项。</span></span></p><p style="text-indent:41px"><strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">第二十三条</span> </span></strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">业主委员会的委员、候补委员和专职工作人员应当遵守法律、法规、规章和管理规约、业主大会议事规则,不得有下列行为:</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(一)妨碍业主大会行使职权或者拒不执行业主大会决定;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(二)挪用、侵占业主共有财产,未按照规定移交属于业主大会和业主委员会的有关财物;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(三)与建设单位、物业服务人或者与其履行职务有利害关系的单位或者个人有不正当经济往来或者利益交换;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(四)违反物业服务合同拒不</span></span><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">支付</span></span><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">物业费;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(五)泄露业主资料或者将业主资料用于与物业管理无关的活动;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(六)伪造或者指使他人伪造业主的选票、表决票、书面委托书或者业主签名,冒充业主或者指使他人冒充业主进行电子投票;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(七)伪造、篡改、隐匿、毁弃或者拒绝、拖延提供物业管理有关的文件、资料,妨碍业主委员会换届交接工作,或者未按照本条例规定刻制、使用、移交业主委员会印章;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(八)违反业主大会议事规则或者未经业主大会授权擅自与物业服务人签订、修改物业服务合同;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(九)拒不执行有关部门、镇人民政府(街道办事处)关于本物业服务区域的整改要求或者人民法院有关生效裁判文书;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(十)连续两次无故缺席或者连续五次请假缺席业主委员会会议;</span></span></p><p style="text-indent:41px"><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">(十一)损害业主共同利益或者未正当履行其职责的其他行为。</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主委员会委员、候补委员存在前款规定情形的,自行终止其职务。</span></span></p><p style="text-indent:41px"><strong><span style="font-family: 'Times New Roman';font-size: 21px"><span style="font-family:仿宋_GB2312">第二十四条</span> </span></strong><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">业主委员会委员、候补委员有以下情形之一时,其委员、候补委员职务自行终止:</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(一)因物业转让、灭失等原因不再是业主的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(二)因疾病等原因丧失履行职责能力的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(三)本人以书面形式向业主大会或者业主委员会提出辞职的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(四)被依法追究刑事责任不再适宜履行业主委员会委员职责的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(五)任职期间因违反本条例规定受到行政处罚的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(六)业主委员会自行解散的;</span></span></p><p style="text-indent:41px"><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">(七)法律、法规和规章以及管理规约、业主大会议事规则规定的其他情形。</span></span></p><p style="text-indent:41px"><strong><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">第二十五条</span> </span></strong><span style=";font-family:'Times New Roman';font-size:21px"><span style="font-family:仿宋_GB2312">职务终止的业主委员会委员应当自公告之日起三日内将其保管的属于业主大会、业主委员会所有的资料、印章等物品交回业主委员会。</span></span></p><p style="text-indent:40px"><span style="font-family:仿宋_GB2312">业主委员会委员实行任期制,每届任期不超过五年,可以连选连任,任期届满的,业主委员会自行解散。业主委员会应当在任期届满前三个月内提请成立换届改选小组,由换届改选小组组织召开业主大会会议选举产生新一届业主委员会。换届改选小组参照筹备组的人员构成组建,并按照筹备组相关规定开展工作。</span></span></p><p
